Our Approach

Roseman Law, APC, has a well established reputation of successfully representing property owners of common interest developments (high-rise, mid-rise and other condominiums, townhouses, planned unit developments), single family residences, commercial and industrial property owners in construction defect actions against developers, general contractors, subcontractors, design professionals and insurers.

These disputes involve a broad array of problems including defective roof systems, window and door systems, stucco/siding, structural components, concrete slab and foundations, HVAC systems, fire protection systems, plumbing, mechanical and electrical systems, balconies and decks, and soil subsidence.

Having provided legal counsel to hundreds of homeowners associations and property owners, our attorneys and support staff are uniquely sensitive to the needs and issues confronting  boards’ and individual property owners.  We actively assist board members and individual property owners in managing the litigation by guiding them through the complex process.

Prior to litigation, we assist our clients navigate through all the pre-litigation stages required by California Law or their unique governing documents.  These include the “Calderon Process” and SB800, ensuring their compliance with the pre-litigation requirements imposed by Civil Code Section 895, et seq.   Further, our firm makes every effort to try and resolve the dispute through alternative dispute resolution (ie: mediation) even prior to filing a lawsuit.  If there is any possibility to resolve the dispute short of litigation, Roseman Law, APC, will explore all such avenues.

Roseman Law, APC, also serves to ensure our clients’ access to the most qualified consultants. We retain only the finest experts, including roofing, decking/waterproofing, engineers (structural, civil, geotechnical), architects, general contractors, industrial hygienists, appraisers and economists to secure the best possible results for our clients.  In many cases, our firm carries the costs of the expert consultants, allowing clients the opportunity to afford the best experts throughout the process.

Should the parties be unsuccessful in resolving the dispute through the mediation process, Roseman Law, APC, will take the case through trial or arbitration. Our attorneys pride themselves on their ability to serve as capable and effective trial counsel.  We have recovered hundreds of millions of dollars on behalf of our clients through trials, arbitrations and mediations. Coupled with obtaining such optimal results, we strive to offer our clients the most cost effective solutions to meet their litigation needs.

Roseman Law, APC, recognizes our clients’ concerns regarding rising legal expenses and actively seeks to control these costs through blended billing rates, fixed fees and, when appropriate, fees contingent or partially contingent on the outcome of the case.
